The terms for using the Cashy platform and website.

These Terms and Conditions ("Terms") are an agreement between you and Cashy Technology, Inc. ("Cashy", "we", "us") for the use of the Cashy platform: our website at cashygame.com, the Cashy platform at play.cashygame.com and institution-branded Cashy subdomains, Cashy Workshops, the Cashy Learning Center embedded on an institution's website or mobile app, and Cashy Classroom. By using any of them you agree to these Terms and to our Privacy Policy. If your bank, credit union, or school has a signed Services Agreement with Cashy, that agreement governs the institution's license, fees, service levels, and data commitments, and it prevails over these Terms where they conflict.
1. Applicability
Capitalized terms used in these Terms have the meanings given in Section 1 of the Privacy Policy. These Terms apply to each of the following:
Institutions: banks, credit unions, schools, and other organizations that license Cashy under a Services Agreement. Where these Terms and your Services Agreement differ, the Services Agreement prevails.
Hosts and admins: employees and volunteers of an institution who run workshops, manage presenters, or view analytics.
Teachers: educators using Cashy Classroom, whether through a sponsoring institution or directly.
Learners: people using the Cashy Learning Center through an institution's website or app.
Students: people using Cashy Classroom in a class run by a teacher.
Participants: anyone who joins a live game or workshop with a PIN or QR code.
Visitors: anyone browsing cashygame.com.
If you are using Cashy on behalf of an organization, you confirm you are authorized to bind it to these Terms.
2. Accounts
Participants do not need accounts. You join a live session with a PIN and a nickname. Choose a nickname that does not identify you or anyone else and is not offensive.
Learners and students sign in with an email address so that progress can be saved. Use an email address you control. Students under 13 may use self-paced lessons only within a program their school or teacher has authorized (see the Privacy Policy, Section 8, and the Student Data Privacy Notice).
Hosts, teachers, and admins receive access from their institution or by registering with a work or school email. Give accurate information and keep it current.
You are responsible for keeping your password confidential and for everything done under your account. Do not share credentials. Notify Cashy at cashy@cashygame.com promptly if you believe your account has been accessed without authorization.
Institution admins may add and remove hosts and presenters for their institution. When an institution's license ends, the accounts it sponsored are closed as described in the Privacy Policy.
3. License
Subject to these Terms, Cashy grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform and its content for financial education, either as part of a program your institution licensed or, for teachers and learners, for your own class or learning. You may print or download materials we mark as printable (worksheets, packets, bingo cards) for use in your sessions.
You may not:
copy, sell, rent, sublicense, redistribute, or publicly display Cashy games, presentations, lessons, videos, worksheets, or other content outside the platform, except printable materials used in your own sessions;
modify, translate, reverse engineer, decompile, or create derivative works of the platform or its content;
remove Cashy or institution branding, copyright, or trademark notices;
use automated tools to scrape, crawl, or bulk-download content, or use Cashy content to train machine-learning models;
share, resell, or provide access to the platform to anyone your institution's license does not cover;
use Cashy to run a competing product or service.
All rights not expressly granted are reserved by Cashy.
4. Acceptable Use
When using Cashy you agree not to:
enter your own or anyone else's Social Security number, account numbers, card numbers, banking credentials, or other sensitive personal information into a game, survey, nickname, or lesson. Cashy does not request such information and has no need of it;
use a nickname, survey response, or free-text field to harass, threaten, impersonate, or demean anyone, or to post unlawful, obscene, or discriminatory content;
interfere with a session you were not invited to, attempt to access other institutions' data, or probe, scan, or test the security of the platform without written permission;
introduce malware, overload the platform, or circumvent access controls, PINs, or rate limits;
use Cashy in violation of any law, including laws that protect children and students;
misrepresent your affiliation with an institution or with Cashy.
Hosts and teachers are responsible for how sessions they run are used with their audiences, including following their institution's or school's policies on student and participant conduct.
5. Institution Programs, Incentives, and Surveys
When you use Cashy through a bank, credit union, or school, that institution sponsors your access and decides which content is available to you within the products Cashy has enabled under the institution's Services Agreement. The Learning Center and Cashy Classroom are enabled per the institution's agreement; the survey email field is off by default and can be enabled only by an institution administrator. Cashy Technology, Inc. is an independent vendor to the institution and is not affiliated with it.
Any reward, incentive, prize, account, or financial product offered in connection with a Cashy program is offered by the institution, under its own terms and eligibility rules. Cashy only reports lesson completion to the institution and is not responsible for awarding, funding, or administering rewards.
If you use the Learning Center through a bank or credit union, that institution can see your learning activity and may contact you about services related to the topics you study, as described in the Privacy Policy and disclosed when you sign in. Students in Cashy Classroom are never subject to this.
Hosts of Cashy Workshops may enable end-of-session surveys. Participation is voluntary. Providing an email address in a survey is optional and permits the institution that conducted the session to contact you. Surveys are not available in Cashy Classroom, and students are never asked for an email address or any other information to take part in a live game.
Institution-branded Cashy pages, and the Learning Center inside an institution's website or app, remain the Cashy platform and are governed by these Terms and the Privacy Policy; the rest of the institution's website or app is governed by the institution's terms.
6. Educational Content; No Financial Advice
Cashy games, presentations, lessons, calculators, and worksheets are for general financial education. They are not financial, investment, tax, legal, or accounting advice, and they are not an offer, recommendation, or endorsement of any financial product or institution. Examples, figures, and calculator outputs are illustrative and may not reflect current rates, laws, or your circumstances. Before making financial decisions, consider talking to a licensed professional. Cashy is not a licensed financial advisor, and neither Cashy nor any institution is responsible for decisions you make based on educational content.
Institutions may add their own content, branding, or messages to their Cashy program. The institution is responsible for that content.
7. Intellectual Property
The Cashy platform, and all games, game mechanics, presentations, lessons, videos, illustrations, characters, worksheets, calculators, software, designs, and text within it, are owned by Cashy Technology, Inc. or its licensors and protected by copyright, trademark, and other laws. "Cashy" and the Cashy logo are trademarks of Cashy Technology, Inc.
Institutions keep ownership of their own names, logos, and any content they supply, and of the usage analytics generated by their program. They grant Cashy a license to display their branding within their program.
Nicknames, survey answers, and lesson responses are not published anywhere; Cashy uses them only to run the session or lesson and to report to the sponsoring institution as described in the Privacy Policy.
If you send us feedback or suggestions, you agree we may use them without obligation to you.
8. Fees
Participants, Learners, Students, and Teachers in sponsored programs are not charged for the use of Cashy.
Institutions pay annual license fees under their Services Agreement, which sets the products, term, pricing, invoicing, and renewal terms.
Teachers or schools that license Cashy Classroom directly pay the fees stated at the time of purchase; unless stated otherwise those fees are for a one-year term, invoiced in advance, and non-refundable once the term begins.
9. Privacy
Our Privacy Policy explains what we collect from each kind of user, how it is used and shared, and the rights you have. In summary: live games operate on nicknames only; learners and students sign in with an email address so that progress can be saved; hosts and teachers hold work accounts; and Cashy never collects Social Security numbers, account numbers, or banking data and never connects to an institution's core systems. Schools should also refer to the Student Data Privacy Notice. Institutional data commitments (hosting, encryption, retention, deletion, incident notice) are set out in the Services Agreement and in security documentation available to Institutions on request.
10. Service Availability and Modifications
Service levels, maintenance windows, and remedies for Institution customers are set out in the Services Agreement. Scheduled maintenance is announced to Institution Administrators in advance.
We add, change, and retire games, presentations, lessons, and features over time. We will not remove functionality an institution has licensed during its term without providing a substitute of comparable value, and we give institution admins at least 30 days' notice of breaking changes to the admin console.
Cashy depends on third-party providers (including AWS) and on your internet connection and device. We are not responsible for outages caused by them.
11. Suspension and Termination
You may stop using Cashy at any time. Learners and teachers can ask us to delete their account by emailing cashy@cashygame.com.
We may suspend or terminate access, with notice where practical, if you breach these Terms, misuse the platform, create risk or legal exposure for Cashy or other users, or if the institution sponsoring your access ends its license.
Institutions terminate under the terms of their Services Agreement. On termination, institution data is exported on request and deleted as described in the Privacy Policy and the Services Agreement.
Sections on intellectual property, disclaimers, limitation of liability, governing law, and any other terms that by their nature should survive, survive termination.
12. Disclaimer of Warranties
Cashy is provided "as is" and "as available". To the fullest extent permitted by law, Cashy disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or that content is complete or current. Institutional customers receive the specific warranties, service levels, and remedies stated in their Services Agreement, which apply instead of this section to the extent they conflict. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
13. Limitation of Liability
To the fullest extent permitted by law, Cashy and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or related to your use of or inability to use Cashy, even if advised of the possibility. Cashy's total liability for all claims relating to the platform will not exceed the greater of the amount you (or your institution, for claims by an institution) paid Cashy in the twelve months before the event giving rise to the claim, or one hundred US dollars ($100). Institutional customers' liability terms are set out in their Services Agreement, which governs where it differs. Nothing in these Terms limits liability that cannot be limited by law, including for fraud or willful misconduct.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property. If you are a consumer, nothing in this section takes away protections you have under the mandatory laws of the place where you live. Before commencing any claim, the parties will attempt in good faith to resolve the dispute by contacting cashy@cashygame.com.
15. Changes to These Terms
We may update these Terms as Cashy and the law change. The effective date at the top shows the current version. For material changes we notify hosts, teachers, and learners by email or in-product notice, and institutional customers through their admin contacts, at least 30 days before the change takes effect where practical. Continuing to use Cashy after a change means you accept the updated Terms. If you do not agree, stop using Cashy and, if you have an account, ask us to close it.
16. General Provisions
These Terms, the Privacy Policy, and, for institutions, the Services Agreement are the whole agreement between you and Cashy about the platform.
If any part of these Terms is found unenforceable, the rest remains in effect.
Our failure to enforce a provision is not a waiver of it.
You may not assign these Terms without our written consent. Cashy may assign them in connection with a merger, acquisition, or sale of assets.
